Composting Toilets in California: Cost & Legal Rules by County

Composting toilets show up on a lot of California property owners' radar for the same few reasons: an off-grid parcel too remote or too rocky to percolate a conventional septic system, an ADU or backyard cottage where the existing septic tank is already near capacity, a cabin with no sewer access, or simply wanting to cut water use in a state that keeps living through drought years. The catch is that there is no single "California law" on composting toilets — whether you can install one, and what it takes to get approved, depends on your county's environmental health department far more than on any statewide plumbing code.

Is a composting toilet actually legal here?

Yes, in most of California — but approval is local, not automatic. The California Green Building Standards Code (CALGreen, part of Title 24) recognizes composting toilets as a voluntary water-conservation measure, and the California Plumbing Code's nonwater-fixture provisions give inspectors a framework to work from. In practice, almost every county's Local Enforcement Agency (LEA) — usually the environmental health division that also oversees septic systems — requires the unit to carry NSF/ANSI Standard 41 certification, the independent test standard confirming the system controls odor, handles rated capacity plus occasional overload, and produces an end product that meets bacterial-reduction limits before it's used as compost. An uncertified DIY or import unit is a much harder sell to a building department, even where the concept itself is welcomed.

Sonoma County is a useful example of how specific the local rules get: Permit Sonoma requires an operational permit (OPR) for a waterless toilet even when the unit itself is NSF 41 certified, because the county treats ongoing management of the composted material as an operating wastewater system, not a one-time installation. Other counties handle it more informally through the same building permit process used for a regular bathroom remodel. Do you still need a septic system?

Usually, yes — just a smaller one. A composting toilet eliminates blackwater (toilet waste) from your plumbing entirely, but it doesn't touch greywater from sinks, showers, dishwashers, and the washing machine, and California still requires that water to go somewhere approved: a conventional septic system, or a permitted graywater system for subsurface irrigation. Full elimination of any septic system is realistic only for very minimal-plumbing structures — a bunkhouse with an outdoor shower and no kitchen sink, for example — not a normal single-family home. Where this actually gets used in California

Why regulators lean on NSF 41 instead of just approving anything

The reason county health departments insist on independent certification rather than taking a manufacturer's word for it comes down to pathogen control. A peer-reviewed review of the composting-toilet literature by Anand and Apul, published in the journal Waste Management (2014), surveyed the engineering and public-health research on how these systems actually perform — temperature, retention time, and moisture control needed to reliably reduce pathogens in the end product, and the tradeoffs against conventional water-based sanitation (available via Google Scholar). That's the underlying reason NSF 41 testing exists in the first place, and why an inspector will ask for certification paperwork rather than just eyeballing a unit — badly managed composting can leave incompletely treated material, which is exactly the failure mode the standard is built to catch.

Getting the permit and the plumbing right
